is us regarding the use and retention of information about
you, some of which will be visible to other members and
some not.
These ‘Terms of Use’ lay out our liabilities
and commitments to you with regard to such data, your privacy,
the site function, otherwise known as the Service, and also
our expectations of you as a user.
Our Commitments to You:
Liabilities
As an online service provider we
agree to run the SouLinks service with due care and attention
to the needs of its members.
We reserve the right and will continue
to develop the site and service, partly in response to member
feedback, and will therefore update the site as deemed appropriate
so long as it does not interfere with the quality of service
provision.
We will endeavour to respond to customer
enquires within 24 hours although on occasions, due to staffing
levels or other unforeseen circumstances, this may be longer.
SouLinks cannot accept liability for loss of service due
to events outside of our normal or reasonable control.
Security of Data
The information that you submit
to SouLinks through the registration and profile creation
process is subject to the Data Protection Act 1998 &
2000, meaning in effect that it will not be disclosed to
other parties for any purpose such as promotional activities.
The member profile you set-up will be
visible to other members using the various site functions.
Any other data about you will only be visible to employees
of the SouLinks organisation and used in managing your membership
and account.
We agree to manage and review your profile
content in a responsible manner commensurate with the site
functions and operating ethos in order to abide by common
decency and avoid upset or offence to other members. We agree to abide
by relevant regulations, legislation and guidelines in this
regard. Particular land based information we may hold about you and which has been derived from the subscription process may be used in the event that we are required to hand over personal details as part of an official police enquiry. This is to further support the safety of our members from those who seek to misuse the site or breach relevant laws or codes of conduct.
The servers used for this site have internal
measures in place to protect the information it holds. As
indicated elsewhere only employees of SouLinks may access
your information as required to assist with your membership
or to address support or other issues.
SouLinks retains no financial information about you as a result of a subscription payment and no personal contact information apart from your email address. All information relevant to your payment is securely held by WorldPay. The highest level available
of secure encryption is employed for all related transmissions and transactions
and also for subsequent confirmation emails.
Continuity of Service
We will endeavour to maintain the
service and site function on an ongoing basis and therefore
provide continuous access to yours and other members’
profiles. However, on occasions when it is absolutely necessary
we may need to temporarily suspend the service for maintenance
purposes.
Where possible we will advise you of
proposed times for any planned interruptions to the service.
Privacy
All data that you submit to us is
considered private except that which you knowingly offer
as part of your visible profile. This also means that you
are afforded anonymity on the site through your SoulName
with regard to other members and that you need only divulge
private information, if and when you wish to, as part of
a connection you feel comfortable with.
The site offers various functions to
support this including the option to hide your profile,
the ability to browse online invisibly and to make any photographs
you upload visible to those you consider friends.
Your Commitments to Us:
Information Submitted
You will submit personal information
to us as part of the registration and profile setting purposes
that is true to the best of your knowledge and which does
not set out to grossly misrepresent or deceive.
Your profile content should not include
personal details and contact information and other data
that you might otherwise include in an internal site email
between members.
Use of the Facility
You agree to use the facility in
the spirit that it was intended, and as set out in these
‘Terms of Use, and not as a means to promote other
businesses or services, send unsolicited emails, engage
in acts, whether actual or implied, that would be considered
unlawful, offensive, defamatory or detrimental to SouLinks,
its members and its operational systems by any relevant
or applicable code or legislation.
You agree that you will keep your password
secure in order to assist us in protecting your personal
data and that you will remain responsible for all the content
that you submit to the site or send to other members and
that you will not engage in activities through the site
that will cause harm or upset to others.
We reserve the right to terminate your
membership at our discretion in the event of unlawful or
inappropriate activities as indicated above.
Intellectual Rights
You should be the owner of the intellectual
rights of any data or content that you send to the site
or transmit to other members. This includes acceptance of
the copyrighted regulations in respect of any content which,
through its appearance on the site, might be construed as
being authored by you.
Subscriptions
While complimentary membership is free, you will agree to pay all relevant subscriptions for full membership status as required and indicated on the site. This will involve our payment processor, WorldPay, holding certain key personal financial data as required to process and manage your subscription payment.
The term ‘Adjustable by merchant’ that shows on the WorldPay payment page for the 1 or 3 month subscription options, refers to the fact that the subscription rates are not permanently fixed but could, with advance notice, be changed by SouLinks Ltd. However, such a change would not occur during a particular subscription period already paid for.
After the completion of any subscription period, and if you have cancelled the auto-rebilling option, you will automatically revert to complimentary membership status with its attendant features and can remain as such indefinitely.
Refund Policy
Once you have submitted a subscription application for a period of either 1, 3 or 12 months, and this has been processed and approved by WorldPay, then we are unable to refund a payment if you should subsequently decide you no longer wish to hold membership.
However, you are entitled at any time to cancel the auto-rebilling feature that will have been set up at subscription by visiting either the Account management section on the site or via the Shopper Management Service at WorldPay. Equally you may at any time cancel your account (delete your profile) with SouLinks at which point no refund will be payable.
Eligibility
All members, either full or complimentary
must be at least 18 years of age. This is not becasue of any adult content on the site but becasue younger members may not have the appropriate level of discernment when striking up connections with anonymous individuals. Registering for the site
must be done on an individual basis and collective company
or business registrations are not permitted.
Your Profile
The profile you create of SouLinks
can be updated at any time. There is no pressure to complete
all the entries although it may be more advantageous for
you if you did.
You have the right to hide you profile,
to show your photographs to friends only or to appear otherwise
offline to other members if required.
We reserve you the right to terminate
your membership and account and have all personal data deleted
from the system through the option available in the membership
section of the site or by writing to us at support@SouLinks.org.
Proprietary Information
The site design is copyrighted to
SouLinks and contains additional data and links relevant
to other parties and affiliated organisations. All such
data is protected through copyright or trademark regulations
and as such may not be reproduced with specific written
agreement from the relevant owner.
SouLinks is not responsible for the content,
arrangements or practices of other sites to which it may
have links.
Disputes
We will try as best we may to resolve
any disputes between members in a manner in keeping with
our ethos.
Failing that any actions sought against other members as
a result of activities occurring on the site must be pursued
independently of SouLinks and with recourse to applicable
law.
